• "Services" refers to all consulting, job posting, and job application features offered via the Platform.
• "Content" includes all information, text, graphics, images, and other materials provided by The Dental Consulting Crew or its users.

2. Eligibility

You must be:

• Legally able to work in Canada (for temp staff);
• A licensed dental office or dental professional in good standing with applicable regulatory bodies;
• Compliant with the applicable provincial and federal employment laws and regulations.

3. Services

The Dental Consulting Crew provides dental consulting, strategy development, temp staff placement and related services. All services are subject to availability and may be modified or discontinued at our discretion.

Temporary Staffing Platform Services

• Dental offices may create a profile and post job openings for temporary positions.
• Temporary staff can create a profile, browse jobs, and apply directly through the platform.
• We do not guarantee job placement or job fulfillment.

4. User Responsibilities

All users agree to:

• Provide accurate, complete, and up-to-date information;
• Use the Platform only for lawful purposes;
• Maintain confidentiality of your login credentials;
• Comply with all applicable laws including but not limited to:

• The Employment Standards Code (Manitoba)
• The Human Rights Code (Manitoba)
• The Personal Information Protection and Electronic Documents Act (PIPEDA)
• The Freedom of Information and Protection of Privacy Act

5. Employment Relationship Disclaimer

The Dental Consulting Crew:

• Is not the employer of record for temp staff;
• Does not guarantee employment, hours, or pay;
• Does not provide payroll or tax services;
• Acts solely as a facilitator between dental offices and temp staff;
• Ensures all hires meet regulatory and professional licensing requirements.

Employers are solely responsible for:

• Compliance with provincial employment laws;
• Paying wages, providing necessary tax forms (e.g., T4), and maintaining records.

6. Privacy and Data Protection

We collect, store, and process personal information in accordance with:

• The Personal Information Protection and Electronic Documents Act (PIPEDA);
• Any applicable provincial privacy legislation.

7. Prohibited Conduct

You may not:

• Post false, misleading, or fraudulent job listings;
• Misrepresent your qualifications or licenses;
• Use automated systems to scrape or access the Platform;
• Interfere with other users' use of the Platform.

8. Intellectual Property

All content and materials provided by The Dental Consulting Crew are the exclusive property of the company and are protected by Canadian copyright laws. You may not reproduce or distribute any part of the Website or Staffing Platform without written permission.

9. Limitation of Liability

To the fullest extent permitted by law, The Dental Consulting Crew and its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, profits, business opportunities, reputation, or data, arising out of or in connection with:

• Any indirect, incidental, or consequential damages;
• Loss of income, business, or data;
• Your use of or inability to use the Platform;
• Any interaction or arrangement between Employers and Temp Staff;
• Any delay, error, or omission in our Services;
• Unauthorized access to or alteration of your transmissions or data;
• Conduct of any third party using the Platform, including other Users.
• Any disputes, misconduct, or non-performance between employers and temp staff.

Even if we have been advised of the possibility of such damages.

10. Disclaimer of Warranties

The Platform and Services are provided on an "as is" and "as available" basis without warranties or conditions of any kind, either express or implied. We make no guarantees regarding the:

• Suitability, accuracy, or availability of job postings;
• Qualifications, reliability, or conduct of any Employer or Temp;
• Accuracy of information provided by users;
• Uninterrupted or error-free operation of the Platform.

You use the Platform at your own risk.

11. Indemnification

You agree to indemnify, defend, and hold harmless The Dental Consulting Crew, its affiliates, employees, and contractors from any claims, damages, losses, or expenses arising from your use of the Website and Staffing Platform, your violation of these terms, or your violation of any third-party rights or applicable law.

12. Payment Terms

If you purchase any consulting services, subscriptions, or downloadable resources through the Website, you agree to provide current, complete, and accurate payment and billing information. All payments are final unless otherwise stated in a written agreement.

13. Termination

We reserve the right to:

• Suspend or terminate your account at any time, with or without cause;
• Remove any content you've submitted;
• Deny access to the Platform at our sole discretion.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Manitoba and the laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts in Winnipeg, Manitoba for any disputes.
